Important — Please Read Before Using GuidingLight™

GuidingLight™ is a directory and connection service only. It is not a licensed healthcare provider and does not provide medical, psychiatric, psychological, or therapeutic services. Use of the Platform does not create any provider-patient or therapeutic relationship.

If you are experiencing a mental health crisis or medical emergency, call 911 or the 988 Suicide & Crisis Lifeline (call or text 988) immediately. Do not use GuidingLight™ as a substitute for emergency services.

1. Acceptance of Terms

By accessing or using GuidingLight™ (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform. These Terms constitute a legally binding agreement between you and The Beacon.

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility and Age Requirements

You must be at least 18 years of age to create an account or use the Platform. By creating an account, you represent and warrant that you are 18 or older. The Platform is not directed to minors. If we become aware that a user is under 18, we will terminate their account immediately.

You must be a United States resident. The Platform is designed primarily to serve Nevada residents and Nevada-licensed or Nevada-registered providers.

3. Not a Healthcare Provider — No Therapeutic Relationship

GuidingLight™ is not a licensed healthcare provider, hospital, clinic, or mental health facility. The Beacon does not practice medicine, psychiatry, psychology, counseling, social work, or any other licensed health profession.

Nothing on the Platform constitutes medical advice, mental health advice, psychiatric diagnosis, clinical assessment, or treatment recommendations. All content is for informational and connection purposes only.

Use of the Platform — including messaging a listed provider — does not create a provider-patient relationship, therapeutic relationship, duty of care, or any clinical or fiduciary obligation between you and any provider, or between you and The Beacon. You are solely responsible for evaluating provider suitability and for all care decisions you make.

4. Emergency Services — Crisis Situations

The Platform is not an emergency service. It cannot dispatch emergency responders or provide real-time crisis intervention. If you or someone you know is in immediate danger or experiencing a mental health crisis, contact emergency services immediately:

  • Nevada Crisis Call Center: 1-800-273-8255

By using the Platform, you acknowledge that you will contact emergency services in a crisis rather than relying on the Platform.

5. HIPAA — Not a Covered Entity or Business Associate

The Beacon is not a HIPAA-covered entity and is not acting as a business associate under HIPAA. The messaging system, profile fields, care planning tools, and other Platform features are not HIPAA-compliant communication channels.

Do not transmit Protected Health Information (PHI) through the Platform, including: Social Security numbers, insurance member IDs, diagnosis codes, medical record numbers, dates of birth combined with other identifiers, prescription details, or lab results.

Providers who are covered entities or business associates under HIPAA remain independently responsible for their own HIPAA compliance. Listing on GuidingLight™ does not satisfy or substitute for any HIPAA compliance obligation.

6. Provider Accounts and Credentials

Providers who create accounts represent and warrant that: (a) all submitted credentials, licenses, and certifications are accurate and current; (b) they are in good standing with all applicable licensing boards; (c) they are not listed on the OIG LEIE or SAM.gov exclusions list; and (d) they will promptly update their profile if their licensure status changes.

Mandatory Reporting: Providers remain fully and independently responsible for their mandatory reporting obligations under NRS 432B and all applicable Nevada statutes. The Platform does not relieve providers of any mandatory reporting duty, and The Beacon is not a mandatory reporter on behalf of any provider.

The Beacon reserves the right to verify credentials, remove listings, and suspend or terminate accounts at its sole discretion.

7. Nevada Telehealth Disclosure

Providers advertising telehealth services must comply with all applicable Nevada telehealth laws and regulations, including Nevada Telehealth Commission rules and NRS Chapter 629. Providers are responsible for ensuring they hold appropriate licensure for all jurisdictions in which their patients are located at the time of service.

GuidingLight™ does not verify telehealth compliance and makes no representation that any listed provider is authorized to provide telehealth services in any particular jurisdiction.

8. User Conduct

You agree not to:

  • Impersonate any person, provider, or organization
  • Submit false, misleading, or fraudulent credentials or information
  • Harass, threaten, or harm any other user
  • Transmit spam, unsolicited marketing, or bulk communications
  • Attempt to access accounts or data you are not authorized to access
  • Use the Platform in violation of any applicable law or regulation
  • Scrape, crawl, or systematically extract data without written permission
  • Use the Platform for any commercial purpose other than those expressly permitted

9. AI-Assisted Features

The Platform includes AI-assisted features including a directory navigation assistant and care planning tools. AI-generated responses are not professional advice of any kind — they are not medical, clinical, legal, or financial advice. AI outputs may be inaccurate, incomplete, or outdated. Do not rely on them for clinical decisions.

Your conversations with AI features may be processed by third-party AI providers. Do not share PHI or confidential information with AI features. See our Privacy Policy for details on AI data processing.

10. Messaging and Communications

Platform messaging is not end-to-end encrypted and is not a secure channel for PHI. All messages are subject to automated content moderation, which may block messages containing crisis language, protected health information, or policy violations. Messages involving potential imminent harm may be escalated to emergency services at The Beacon's discretion.

11. Payments and Subscriptions

Provider subscriptions are billed through Stripe, Inc. By subscribing, you authorize recurring charges. Cancellations take effect at the end of the current billing period. The Beacon does not store full payment card information. Refunds are handled at The Beacon's discretion.

12. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. THE BEACON IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY LISTED PROVIDERS, OR FOR ANY HARM ARISING FROM YOUR INTERACTIONS WITH THOSE PROVIDERS.

TO THE MAXIMUM EXTENT PERMITTED BY NEVADA LAW, THE BEACON'S AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE BEACON IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

13. Governing Law

These Terms are governed by the laws of the State of Nevada. Any disputes shall be resolved exclusively in the state or federal courts located in Clark County, Nevada. You consent to personal jurisdiction in those courts.
